Persons with Disabilities to Receive Constitutional Protection After Unanimous Parliamentary Vote

The Maltese Parliament has unanimously approved a constitutional amendment that will, for the first time, include disability as a protected characteristic under Malta’s Constitution, strengthening legal protections for persons with disabilities.

The amendment, presented by Minister for Inclusion and Volunteering Julia Farrugia, extends constitutional safeguards relating to fundamental rights and freedoms. While persons with disabilities already enjoy rights through Malta’s international obligations and domestic legislation, the Minister explained that the Constitution did not previously allow individuals or entities to bring constitutional claims specifically relating to disability discrimination or violations of fundamental rights.

Minister Farrugia said the reform does not create new rights but ensures that constitutional protection is formally extended, allowing individuals to seek legal redress where their constitutional rights are breached.

Speaking in Parliament, the Minister described the vote as an important step, stating: “We are confirming, in the highest law of the country, that every person with a disability in Malta and Gozo is also part of our nation.”

The Minister also emphasised that the constitutional amendment forms part of a broader programme of reforms. These include extending personal assistance and personal budget schemes to support independent living, alongside complementary legislation aimed at strengthening protection against disability discrimination, improving enforcement mechanisms, access to justice and relevant institutional structures in line with Malta’s national and international obligations.
